Details of Statutory Instruments and accompanying Explanatory Memos (where applicable) bringing the 1 October commencement package for the Equality Act into effect

This was made on 5 July. It switches on powers to make orders and regulations that need to be made in connection with October commencement.

This was made on 3 August. It supplements the provisions previously commenced by Commencement Order No.1.

This affirmative order was laid in draft on 14 July, debated in the House of Lords on 26 July and approved by them on 28 July; then debated by the House of Commons on 13 September and approved by them on 14 September. Following approval it was signed and published on 20 September in final form. It is basically a technical document which makes various knock-on changes to the Act and to references made in other primary legislation. . Due to enter into force on 1 October.

This negative order was made by the Privy Council on 28 July. It makes use of the power in section 82 of the Act to apply Part 5 (work) to offshore work. Due to enter into force (subject to Parliament) on 1 October.

This negative order was laid on 30 July. It uses the power in Schedule 12, paragraph 5 to designate certain Catholic 6th form colleges as institutions which may select pupils on religious grounds for courses of non-vocational training. Due to enter into force (subject to Parliament) on 1 October. Maintains existing practice.

This negative order was made on 2 September and authorises Fellows of the Institute of Legal Executives to advise on out-of-court settlements. Due to enter into force (subject to Parliament) on 1 October.

This order was made on 2 September and supplements the provisions previously commenced by Commencement Order No.1.

This negative order was laid on 7 September and prescribes questions and answers forms for voluntary use prior to making a possible claim. The Order came into force on 1 October and the full forms with guidance are available from here.

These negative Regulations were laid on 31 August and consolidate saved provisions under the 1995 Disability Discrimination Act. Due to enter into force (subject to Parliament) on 1 October.

This negative order was laid on 31 August and to ensures certain practices, actions or decisions that apply to Occupational Pension Schemes can apply to contributions made by employers to Personal Pension Schemes. It also replicates exemptions from the non-discrimination rule in relation to rights accrued or benefits payable. Due to enter into force (subject to Parliament) on 1 October.

These negative Regulations were laid on 31 August and specify exceptions to the sex equality rule in occupational pension schemes. Due to enter into force (subject to Parliament) on 1 October.

These negative Regulations were made on 9 September and designate Ofqual as the appropriate regulator, and define relevant qualifications, in order to allow Ofqual to be able to specify when the duty to make reasonable adjustments does not apply or reasonable adjustments need not be made by a general qualifications body in relation to conferments in England. Due to enter into force (subject to Parliament) on 1 October.

This Order was made on 20 September and commences most of the Act. Due to come into force on 1 October.

This commencement order was made on 17 January. It commences  powers to make orders and regulations in connection with the public sector Equality Duty (sections 150 (partially), 151 – 155 and 157 and Schedule 19) as from the day after the day on which the order was made. It also commences, on 6 April 2011, section 159 of the Act (positive action in recruitment and promotion).
